For co-parents in a high-conflict dynamic, there is a presumption that the only solution is litigation and that a judge will decide who is right and who is wrong. As a mediator, I am quite familiar with this way of thinking. Parties come to me after being ordered by the court to mediate, and they say: “I don’t understand how this is going to work; he/she won’t listen to reason, and there is no way that he/she will agree to anything, so why did the court order us to mediation?
